These Terms and Conditions ("Terms") govern your use of the website located at bismarckmasonry.com and any services provided by Bismarck Concrete & Masonry ("we," "our," or "us"). By using our website or requesting services, you agree to these Terms. Please read them carefully.
By accessing our website, submitting a contact or estimate request, or entering into a service agreement with Bismarck Concrete & Masonry, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, please do not use our website or request our services.
These Terms apply to all visitors, customers, and anyone who interacts with our business through the website or any other channel.
Bismarck Concrete & Masonry provides masonry contracting services including, but not limited to, foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, and related concrete and masonry work. Services are offered in Bismarck, North Dakota, and surrounding communities.
All services are subject to an on-site assessment. We reserve the right to decline a project if, in our professional judgment, it falls outside the scope of our capabilities or presents conditions we are not equipped to address.
We provide written estimates following an on-site assessment. An estimate represents our best projection of the cost of the proposed work based on conditions observed at the time of the visit. Estimates are not binding contracts.
If conditions discovered during the work differ materially from those observed during the initial assessment - such as hidden structural damage, soil conditions, or subsurface issues - we will notify you before proceeding and provide a revised scope and price. We will not continue work beyond the original estimate without your written or verbal approval of the revised scope.
Verbal estimates or ballpark figures provided over the phone are not binding. A final price is only established through a written estimate following an on-site visit.
Work is scheduled based on mutual availability and seasonal conditions. Masonry work in North Dakota is subject to weather delays, particularly during periods of freezing temperatures or precipitation that prevent mortar from curing properly. We will notify you as promptly as possible if a scheduled appointment must be rescheduled due to weather or other circumstances outside our control.
If you need to cancel or reschedule a confirmed appointment, please notify us as soon as possible. Cancellations made with less than 24 hours' notice may result in a fee to cover crew scheduling costs, at our discretion.
We reserve the right to reschedule work at our discretion for reasons including safety concerns, equipment issues, or workforce availability. We will make reasonable efforts to accommodate your schedule when rescheduling.
Payment terms will be specified in the written estimate or service agreement for each project. Generally, we may require a deposit before work begins, with the remaining balance due upon completion of the work.
Accepted payment methods will be communicated at the time of estimate. Failure to make timely payment may result in work stoppage, a lien on the property in accordance with North Dakota lien law, or referral to a collections process. Outstanding balances may accrue interest at the maximum rate permitted by applicable law.
To allow us to complete work safely and efficiently, you agree to:
We are not responsible for damage to property that results from your failure to disclose relevant conditions or to provide reasonable access.
Where a written warranty is provided for a specific project, the terms of that warranty govern. In the absence of a written warranty, our work is provided without any express or implied warranty of merchantability or fitness for a particular purpose.
Masonry and concrete work is subject to the effects of weather, soil movement, freeze-thaw cycles, and other environmental conditions that are outside our control. We are not responsible for damage caused by events occurring after project completion, including but not limited to severe weather, flooding, soil settlement, or improper maintenance.
Any warranty provided applies to the specific repair or installation work performed and does not cover adjacent materials, pre-existing conditions, or damage caused by third-party work performed after our project is complete.
To the fullest extent permitted by law, Bismarck Concrete & Masonry shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services or your use of our website. This includes loss of use, loss of revenue, or cost of substitute services.
Our total liability for any claim arising from services we perform shall not exceed the total amount paid by you to us for the specific project giving rise to the claim.
The content on our website is provided for informational purposes only. We make no warranties about the accuracy, completeness, or reliability of any information on the site. You use the website and its content at your own risk.
You agree not to use our website in any way that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use of the website. Unauthorized use of our website may give rise to a claim for damages.
We prefer to resolve any disputes directly and informally. If you have a concern about our work or billing, please contact us first so we have an opportunity to address it. We take customer satisfaction seriously and will make reasonable efforts to find a fair resolution.
If we are unable to resolve a dispute informally, the parties agree to attempt good-faith mediation before pursuing formal legal proceedings. Any formal legal action shall be brought in the courts of North Dakota and shall be subject to the governing law described below.
These Terms and any dispute arising out of your use of our website or our services shall be governed by and construed in accordance with the laws of the State of North Dakota, without regard to its conflict of law provisions.
We reserve the right to update or modify these Terms at any time. When we do, we will post the revised Terms on this page with an updated effective date. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
If a change materially affects a current service agreement, we will make reasonable efforts to notify you directly.
